Your UK Prenup Requires Reading Before You Sign – Here’s Why by Tim Bishop
With any legal document, it can sometimes be difficult to pick your way through it to ensure you understand it properly.
But you need to do just that in every single case, and definitely when it comes to a UK prenup, also referred to as a prenuptial agreement. This is a document that will be looked at in the future should you ever decide to get a divorce From Your partner. A UK prenup may not be legally recognised in the UK at the moment, but this could change in the future. In any event, if you sign one now before you marry your partner, it will pay dividends to ensure you have read every word and you understand it completely.
This is true regardless of which partner instigated the idea of setting up a UK prenuptial agreement. The key word there is ‘agreement’ – you should both agree on the terms before you sign it. If there are any disagreements you need to sort them out between you before you sign and certainly before you get married. The document needs to be signed at least three weeks before the date of the wedding, and this is the shortest time you should think about. This means it makes sense to ensure the UK prenup is dealt with in plenty of time. Make sure you read through every part of it and ask your solicitors for advice in clarifying anything you don’t understand [when instructing a solicitor, make sure you appoint divorce solicitors who have plenty of experience of the UK prenup]. Never assume you understand something or think that it doesn’t matter if something is a bit vague. If you sign it and you eventually end up in the divorce courts, you could be rueing the day you didn’t bring the matter up – before you signed on the dotted line.
The point is that even if the UK law never recognises a UK pre-nuptial agreement, it may still be looked at by a judge and taken into consideration when deciding the outcome of the divorce in financial terms. This means that you must both be sure of what has been laid out in the document. Even if you sign it, get married and then want to make a change of some kind, this will not happen. Even if you could make such a change it would be very likely to be disregarded in favour of the original document should your marriage end in divorce. In short, the more attention you pay to your UK prenup before you get married, the better. If you have confidence in it and you agree with it, you can be assured that you have signed the right thing.
